‘Un drame dans une maison de fous’. L' "affaire d'Evere" (Bruxelles, 1871-1872), ce qu'elle révèle du régime des aliénés en Belgique, ses effets dans un contexte propice à la réforme

De instelling voor aliénisten werd opgericht in Evere in 1854. Na een decennium van voor- beeldig beheer, althans volgens de autoritei- ten, kwam er in de loop van de jaren 1860 steeds meer kritiek. De verschillende organen belast met het toezicht op de krankzinnigen- gestichten kloeg het zorgwekkend en onmen- selijk beheer ervan aan bij het Ministerie van Justitie, het hoogste toenmalig gezag op dit gebied. Toen de directeurs van de instelling na verschillende waarschuwingen zijn richtlijnen niet wilden opvolgen, aarzelde de minister om de inrichting te sluiten. Maar, in december 1871 kondigde de procureur des konings van het arrondissement Brussel aan dat een onder- zoek bevolen was naar een dubbele moord in de instelling. Dit onderzoek onthulde de omvang van de problemen en de minister besloot tot sluiting over te gaan. Dit veroor- zaakte echter hevige emoties bij het publiek. De Belgische aliénisten eisten erkenning voor hun specificiteit en legitimiteit en gebruikten het schandaal om een debat te ontketenen over het regime van de aliénisten, en vooral over de plaats die voor hen in de psychiatri- sche instellingen gereserveerd moest worden. Maar het debat ontspoorde al vlug in de rich- ting van de nationalisatie van de gestichten. Sommigen beschouwden dit de enige aan- vaardbare oplossing om de zorg voor de ali- enisten te verzekeren. Deze keuze droeg ook de goedkeuring weg van de radicale vleugel van de liberale partij, die in die periode ijverde voor de laicisering van de maatschappij. Maar in een politieke context die weinig ruimte liet voor het idee van staatsinterventie was het debat van korte duur. De wet die uiteindelijk in 1873 ingevoerd werd, ter herziening van deze van 1850, was weinig ambitieus. De wetgever kwam op pragmatische wijze tegemoet aan de problemen in Evere, zonder het regime van de aliénisten grondig te hervormen, en behield enkel de meest aanvaardbare voorstellen die door hen voorgesteld werden.

Apres une décennie marquée par une gestion jugée exemplaire par les autorités, |’asile pour aliénés d’Evere, fondé en 1854, suscite des critiques de plus en plus vives au cours des années 1860. Les différentes instances char- gées de la surveillance des asiles du royaume dénoncent en effet sa gestion déplorable et inhumaine auprés du ministre de la justice, qui a alors la haute autorité dans ce domaine. Constatant la mauvaise volonté des directeurs de I’asile, qui tardent a se remettre en ordre malgré plusieurs avertissements, le ministre hésite a faire procéder a la fermeture de la mai- son de santé quand, en décembre 1871, le pro- cureur du roi de l’arrondissement de Bruxelles l’avertit qu’une instruction vient d’étre ouverte pour enquéter sur un double homicide qui y serait survenu. Cette enquéte, qui permet de constater toute l’ampleur des problémes qui gangrenent l’asile, décide le ministre a fermer celui-ci, et provoque une vive émotion auprés du public.

Les aliénistes belges, qui cherchent alors a faire reconnaitre leur spécificité et leur légitimité, se saisissent du scandale afin de faire émerger un débat sur la question du régime des aliénés et plus spécifiquement de la place qui devrait leur étre réservée dans les asiles. Le débat dévie toutefois rapidement sur la question de l’étatisation des asiles, que d’aucuns consi- dérent comme la seule option satisfaisante si l’on veut s’assurer de la qualité de la prise en charge des aliénés, et qui rencontre également le soutien de l’aile radicale du parti libéral, qui poursuit alors systématiquement la laicisa- tion de la société. Dans un contexte politique peu ouvert a |’idée de I’intervention de l’Etat, le débat tourne toutefois court, et la loi qui finit par étre promulguée en 1873 pour réviser celle de 1850 est peu ambitieuse. Le législa- teur se contente en réalité de répondre prag- matiquement aux problémes constatés a Evere, sans véritablement révolutionner le régime des aliénés, et ne retient que les idées les plus rai- sonnables formulées par les aliénistes.

 “A Tragedy in a Lunatic Asylum ”, The “Evere Affair” (Brussels, 1871-1872) - Abstract

After a decade of, according to the authorities, exemplary management, the asylum for alien- ists, founded in Evere in 1854, attracted more and more criticism in the course of the 1860s. The different bodies in charge of the surveil- lance of the country’s asylums denounced the deplorable and inhuman management to the Ministry of Justice, the highest authority in this field at the time. Observing the ill will of the directors of the asylum, who after repeated warnings failed to comply with instructions, the minister hesitated to proceed to the closure of the clinic. However, in December 1871, the royal prosecutor of the Brussels district announced that an inquiry was ordered into a double homicide in the asylum. This investi- gation revealed the extent of the problems that festered and the minister decided to close the institution, which sparked profound emotions among the public. The Belgian alienists then wanted to gain recognition for their specificity and their legitimacy and seized on the scan- dal to induce a debate on the question of the regime of the alienists, and particularly on the place that should be reserved for them in the asylums. But the debate quickly digressed to focus on the question of the nationalization of the asylums. Some considered this the only viable option if the quality of the care of the alienists was to be guaranteed. This option also had the support of the radical wing of the liberal party, which was at this point system- atically pursuing the secularization of society. However, in a political context not very open to the idea of state intervention, the debate was short-lived. The law that was finally enacted in 1873, revising the one of 1850, showed little ambition. In reality, the legislator merely responded in a pragmatic way to the problems in Evere, without restructuring the regime of the alienists, and retained only the least inspiring ideas proposed by the alienists.
